The current mayor, Dada Morero, fired him a few days ago.
Investigations into the fraud claims are ongoing.
The former mayor is demanding a public apology, retraction of statements and for Mthembu to refrain from further commentary on his disciplinary matters.
Should his requests not be met by November 14, Gwamanda has indicated that he may pursue legal action to apply to the high court to prevent Mthembu from making additional statements about him.
“Should this matter remain unresolved [on the] deadline of Thursday, we reserve the right to consider further legal proceedings to address both procedural and substantive irregularities.
“In recent months, a series of actions and statements by your office have created a climate of hostility and prejudice towards our client. These actions, while presented as matters of council interest, have unfairly targeted our client and conveyed a prejudgment on matters that remain unresolved, effectively undermining his right to due process and impartiality,” argued his lawyers.
Mthembu’s spokesperson Mzwandile Khathi said the speaker was aware of the letter.
“I can confirm that the speaker has received a letter from Gwamanda’s lawyer but she will not be commenting at this stage since it’s now a legal matter,” said Khathi.
